A US federal court has issued a ruling that deals a serious blow to Elon Musk's xAI. Judge Rita Lin completely dismissed the company's lawsuit against OpenAI regarding trade secret violations, with prejudice, meaning the case is closed permanently.
The core of the dispute was the allegation that OpenAI had induced former xAI engineer Xuecheng Li to disclose confidential information about the Grok chatbot during the hiring process. However, the judge found no evidence to support these claims. She noted that Li's presentation during the interview, where he discussed his work experience, including reinforcement learning and post-training systems for Grok 4, is standard practice in employment. Discussing previous experience, even if it concerns competitors, does not equate to inducing the transfer of trade secrets.
This is already the second major defeat for Musk in his legal battles with OpenAI in the past month. Earlier, in May, a jury dismissed his separate $150 billion lawsuit, which was filed on other grounds.
Analyst's comment: This court ruling strengthens OpenAI's legal position and sets a precedent that will complicate future attempts by xAI or other companies to block employee transitions through trade secret violation allegations.
