The large-scale construction of data centers in Texas reveals a troubling trend: developers are actively exploiting loopholes in environmental legislation to avoid public hearings and expedite permits for building their own power plants. This involves using a simplified procedure originally designed for standard and small emission sources.

The essence of the maneuver is that companies submit applications for individual turbines and generators, bypassing the mandatory environmental review and resident notification required for large facilities. As an investigation showed, since 2024, at least 38 data centers have received permits for their own generation under this scheme. More than half of them deliberately understate their reported nitrogen oxide emissions to just below the 100-ton-per-year threshold, beyond which public procedures kick in. A striking example is the Vantage data center near San Antonio, which received a permit for 99.8 tons of emissions.

Former employees of the Texas Commission on Environmental Quality (TCEQ) describe this strategy as "small first, big later." Projects are broken down into small applications and then combined into industrial power plants. According to experts, this practice may contradict requirements to consider interconnected parts of a project as a whole.

Stargate: A Flagship Example

The central case is the Stargate data center in Abilene, part of the infrastructure initiative by OpenAI, SoftBank, and Oracle with announced investments of up to $500 billion. In 2024, developers received simplified permits for 10 gas turbines and 62 diesel generators. According to documents, this equipment can emit over 1.6 million tons of greenhouse gases and about 1,000 tons of other pollutants annually. Notably, a representative of developer Crusoe claims the turbines will only be used for backup power, but the current permits allow for their continuous operation. Within a year, an application was submitted for 41 additional turbines and 18 generators, which, if implemented, would provide energy for over 1 million homes, with annual pollution comparable to emissions from nearly 2 million cars.

Scale of the Threat: 40 GW of Gas for Data Centers

Texas already has about 300 operating data centers, with roughly another 200 in development. According to Global Energy Monitor, the state has 80.6 GW of new gas-fired power plants announced, nearly half of which (about 40 GW) are intended for direct power supply to data centers. In terms of gas capacity under development, Texas is second only to China. Analysts at Cleanview identified 59 data centers in the U.S. with plans to build their own power plants with a total capacity of about 90 GW, but only 2 GW were operational by mid-2026.

An investigation by Floodlight, which examined documents from nine gas plants linked to data centers, showed that their permitted emissions could exceed 130 million tons of greenhouse gases per year. The TCEQ regulator, despite over 100,000 inspections in 2025, did not respond to specific questions about the investigation's findings, citing a high level of compliance. OpenAI and Crusoe, for their part, emphasize the economic benefits of the projects for local communities.

My analysis: This situation is a classic example of "regulatory arbitrage," where businesses use formal loopholes to speed up processes at the expense of environmental transparency. Given the colossal scale of the announced capacities, Texas risks facing not only pollution problems but also an overload of the energy system, as analysts at Bloomberg have already predicted. The AI market is growing exponentially, but its infrastructure safety net is clearly lagging behind the ambitions.
