The Bank of Russia publishes the first regulatory drafts for cryptocurrency market regulation: capital and trading requirements.
The Bank of Russia has taken the first step towards formalizing the Russian cryptocurrency market by publishing draft regulations that lay the foundation for organized trading of digital assets. In my opinion, these documents mark a transition from fragmented initiatives to systematic regulation.
The key element of the drafts is the creation of a legal framework for exchange trading, where the market and weighted average prices of crypto assets will be calculated. This means the regulator aims to introduce transparent pricing mechanisms, which is critically important for institutional investors and for reducing volatility in the early stages.
Capital Requirements for Depositories
Special attention in the documents is given to depositories, which will keep records of cryptocurrencies and digital rights. A minimum equity capital requirement has been set for them, ranging from 50 to 250 million rubles, depending on the specifics of their activities. In my view, this gradation is aimed at protecting client assets and preventing risks associated with insufficient capitalization of market participants.
The drafts also stipulate that exchanges will be required to calculate and publish weighted average prices, creating benchmarks for over-the-counter transactions and tax accounting. This is particularly relevant in a context where Russian companies are increasingly showing interest in cryptocurrencies as a tool for international settlements.
My expert analysis: These steps by the Central Bank of Russia appear balanced and timely. Establishing clear rules of the game for exchanges and depositories is not just bureaucracy, but a necessary condition for attracting large capital. However, the key challenge will remain the balance between control and flexibility: overly strict requirements could stifle innovation, while weak oversight could lead to a repetition of the mistakes of unregulated markets.
