Russia opens the door for advertising crypto services, but digital assets remain banned

Russian legislation is taking a landmark, albeit extremely cautious, step toward legalizing the crypto industry. The new law for the first time permits advertising of services by licensed crypto market participants, yet promotion of digital currencies themselves as an investment instrument remains strictly prohibited. This is a subtle but fundamental distinction that radically changes the rules of the game for all market players.

Previously, advertising of any cryptocurrencies and related services was effectively completely blocked. Now, the regulator draws a clear line between advertising digital currency as such and advertising services provided by legal players. The key point here is the advertiser's status. Only organizations included in the official registry—trading organizers, brokers, digital depositories, and exchanges—will be able to promote their services.

What is allowed and what is not

Calls to buy Bitcoin, Ethereum, or any other coins with promises of price growth remain prohibited. It is also forbidden to advertise cryptocurrency as a means of payment for goods and services within Russia. Any mention of yields, past profits, or a reliable way to earn money will be considered toxic and will entail liability.

Permitted advertising must be as restrained and informative as possible. It must include the name of the digital currency circulation organizer, the source of disclosed information, and warnings about high risks and the possible total loss of funds. It is also necessary to state where the client can familiarize themselves with the risks and legislative restrictions. At the same time, naming specific coins in service advertising is not allowed—only mentioning access to operations through a regulated participant.

All channels under control

The new requirements apply to all communication channels: from banners and outdoor advertising to Telegram posts, influencer integrations, YouTube videos, landing pages, and email newsletters. For websites and social media, an internet advertising labeling regime additionally applies: it is necessary to obtain an identifier and transmit data through an advertising data operator.

It is important to understand that an informational article about cryptocurrencies does not in itself become advertising. Writing about blockchain technology, regulation, case law, or mining is freely permitted. Problems begin where promotion of a specific platform appears, such as a referral link, a call to open an account, or a promise of earnings.

Outdoor advertising is a separate headache for marketers. Formally, it is possible for permitted services, but in a short format it is extremely difficult to place all mandatory warnings. Therefore, this channel will remain inconvenient and risky for crypto services.

Fines and prospects

Violations of the advertising law carry fines under Article 14.3 of the Russian Administrative Code: for individuals—from 2,000 to 2,500 rubles, for officials—from 4,000 to 20,000 rubles, for legal entities—from 100,000 to 500,000 rubles. Separate sanctions are higher for violating internet advertising labeling: fines reach 500,000 rubles for companies. If advertising leads to illegal activity, the risks go far beyond advertising fines—for the illegal organization of digital currency circulation and mining, liability of up to 1–2 million rubles for legal entities is provided.

This is not full legalization of cryptocurrency advertising, but a narrow exception to the previous ban. Only services of regulated participants can be promoted, in a restrained manner, without promises of yields or mention of specific coins. In essence, advertising will become more banking-like in tone.

My view: The main advertisers will most likely be banks, brokers, and large financial groups that already have compliance, lawyers, and a habit of working with the regulator. For independent crypto companies, this is more of a challenge than an opportunity: meeting all requirements while remaining visible against the backdrop of giants will not be easy.
