New era of marketing: Russia has allowed advertising of crypto services, but with caveats

The Russian digital asset market is entering a new phase of its development. The adopted legislative changes for the first time open up a legal opportunity to promote the services of licensed cryptocurrency market participants. However, it is important to understand: this is not a "green light" for advertising the coins themselves, but rather a targeted easing in what was previously an impenetrable wall of prohibitions.

What exactly is allowed, and what remains prohibited?

The key distinction that all market participants must grasp is the division between advertising digital currency as such and advertising services related to its circulation. Promoting Bitcoin, Ethereum, or any other asset with the message "buy, it will grow" remains illegal. Likewise, popularizing cryptocurrency as a means of payment for goods and services within the Russian Federation is also prohibited. Any hints at profitability, exchange rate growth, or a "reliable way to earn money" will be regarded as toxic and suppressed.

So what can be advertised then? Exclusively the services of trading organizers, brokers, digital depositories, and exchangers that will operate within the new legal framework. But even here there are strict conditions: the advertisement must indicate the name of the organizer, the source of disclosed information, a warning about high risks and the possible total loss of funds. It is also necessary to state where the client can familiarize themselves in advance with the risks and legislative restrictions.

Marketing nuances: from social media to outdoor advertising

The new requirements apply to all communication channels: from banners on websites and posts in Telegram to integrations with bloggers, YouTube videos, and outdoor advertising. For online platforms, mandatory advertising labeling is added, with data transmitted through the advertising data operator. This is especially critical for the crypto sphere, where failure to comply simultaneously with special requirements on digital currencies and internet advertising rules compounds the risks.

At the same time, it is important to note: an informational article about cryptocurrencies is not in itself advertising. One can freely write about the technology, regulation, judicial practice, and risks. Problems begin where promotion of a specific platform appears, a referral link, or a call to action — to open an account, buy an asset, or receive a bonus.

The cost of the issue: fines and prospects

Violating advertising legislation threatens fines under Article 14.3 of the Code of Administrative Offenses of the Russian Federation. For citizens — up to 2,500 rubles, for officials — up to 20,000, for legal entities — up to 500,000 rubles. Separate sanctions for the lack of labeling of internet advertising are significantly higher: for companies — up to 500,000 rubles. And if advertising leads to activity without the necessary status, liability goes far beyond advertising fines, reaching 1–2 million rubles for legal entities.

It is obvious that advertising will become more "bank-like" in tone. The main advertisers will most likely be banks, brokers, and large financial groups that already have compliance, lawyers, and a habit of working with the Central Bank. For the crypto market, this is not full legalization, but a narrow exception to the previous ban, which will allow talking about legal services, but not about the coins themselves.

My view: this is a pragmatic step by the regulator, which is trying to bring the market out of the shadows without losing control. However, for small crypto startups, these rules may become an unbearable burden, leading to further consolidation of the market around large players. Advertising will become a tool not for attracting a new audience, but for fighting over already informed users among the giants.
