Texas data centers bypass environmental regulations: how AI giants mask emissions

The data center market in Texas is experiencing an unprecedented boom, but behind this growth lies a troubling trend: developers are actively exploiting legal loopholes to avoid public environmental scrutiny. Instead of undergoing full permitting procedures with mandatory public hearings, companies obtain simplified permits for individual turbines and generators, allowing them to start construction without notifying local residents.
Originally, the simplified procedure was designed for small, standard emission sources. However, it has now become a tool for breaking down large-scale projects. Since 2024, at least 38 data centers in Texas have received permits for on-site power generation under this scheme. More than half of them reported nitrogen oxide emissions volumes just shy of the 100-ton-per-year threshold that triggers public hearings. For example, the Vantage data center near San Antonio received a permit for 99.8 tons of emissions — precisely on the borderline to remain "unnoticed."
Former employees of the Texas Commission on Environmental Quality (TCEQ) describe this strategy as "start small, then go big." Companies split a single project into numerous small applications and then combine the installations into full-fledged industrial power plants. Bruce Buckheit, former director of EPA's air enforcement division, stated outright that this practice may violate requirements to consider interconnected parts of a project as a whole.
Stargate: A flagship example of regulatory circumvention
The central case in this investigation is the Stargate data center in Abilene — part of the ambitious infrastructure initiative by OpenAI, SoftBank, and Oracle with announced investments of up to $500 billion. In 2024, developers obtained simplified permits for 10 gas turbines and 62 diesel generators. According to documents, this equipment is capable of emitting over 1.6 million tons of greenhouse gases and about 1,000 tons of other pollutants annually. A representative of developer Crusoe claims the turbines are intended only for backup power, but the current permits allow for their continuous operation. Within a year, the company filed an application for a main permit for 41 additional turbines and 18 generators. If realized, the power plant's capacity would be sufficient to power over 1 million homes, and annual air pollution would be comparable to emissions from nearly 2 million vehicles.
Gas appetite: 40 GW for data centers
Texas already hosts about 300 data centers, with approximately 200 more in development. According to Global Energy Monitor, 80.6 GW of new gas-fired power plants have been announced in the state, with nearly half of that capacity — about 40 GW — intended for direct power supply to data centers. Analytics firm Cleanview identified 59 data centers in the U.S. with plans to build their own power plants totaling about 90 GW, but as of mid-2026, only 2 GW had been brought online. Examining documents from nine gas plants linked to data centers, Floodlight calculated that their permitted emissions could exceed 130 million tons of greenhouse gases per year.
The regulator TCEQ, for its part, cites a high level of compliance and completed inspections but does not comment on the specific findings of the investigation. OpenAI and Crusoe, while promising to consider the impact on local communities, have not provided detailed comments on the matter.
My analyst comment: This situation is a classic example of the conflict between rapid technological progress and environmental responsibility. The development of AI and cloud computing requires enormous energy capacity, but circumventing environmental regulations is unacceptable. Investors and market participants should closely monitor developments: tighter regulation in Texas could set a precedent for the entire industry, significantly impacting the cost and timelines of future projects.
