In Russia, a window has been opened for advertising crypto services: what is allowed and what remains prohibited

The Russian digital assets market is taking another cautious step toward legalization. The new law for the first time permits advertising of services offered by licensed cryptocurrency market participants, yet direct promotion of the coins themselves — bitcoin, Ethereum, and others — remains strictly prohibited. This is an important signal that changes the rules of the game for many players, but it does not lift previous restrictions.

A Fine Line: Services vs. Coins

The key feature of the new regulation is a clear distinction between advertising digital currency as such and advertising services provided by regulated market participants. Promoting bitcoin with phrases like "buy now, it will rise" or promises of returns is not allowed — such statements are deemed toxic under Russian law. It is also prohibited to position cryptocurrency as a means of payment within the country.

Permitted advertising concerns exclusively the services of trading organizers, brokers, digital depositories, exchangers, and other entities stipulated by law. But even here there are strict conditions: the advertisement must state the name of the organizer, disclose the source of information, warn about high risks and the possible total loss of funds. In addition, the client must know in advance where to review the risks and legislative restrictions on digital currency transactions.

A separate nuance — specific coins cannot be mentioned. A call to open an account and buy bitcoin would look extremely risky. A safe strategy is to talk about access to digital currency operations through a regulated participant, without mentioning specific assets and without investment promises.

Distribution Channels and Liability

The advertising law applies regardless of the channel. A banner on a website, a post on Telegram, an influencer integration, a YouTube video, outdoor advertising, a landing page, push notifications, or an email newsletter — all of this falls under regulation. For websites and social media, internet advertising labeling is additionally required: an identifier and data transmission through an advertising data operator. For the crypto sphere, this is especially important, since violating both special requirements and labeling rules at the same time compounds the risks.

It is important to understand: an informational article about cryptocurrencies does not in itself become advertising. Writing about the technology, regulation, case law, mining, or international approaches is freely allowed. Problems begin where promotion of a specific platform appears, a referral link, a call to open an account, or a promise of earnings.

Fines for violating advertising legislation are provided for under Article 14.3 of the Russian Administrative Code: for individuals — from 2,000 to 2,500 rubles, for officials — from 4,000 to 20,000 rubles, for legal entities — from 100,000 to 500,000 rubles. For violations in internet advertising, sanctions are higher: the absence of an identifier threatens individuals with a fine of 30,000–100,000 rubles, officials — 100,000–200,000 rubles, legal entities — 200,000–500,000 rubles.

If advertising leads to activity without the necessary status, the risks go far beyond advertising fines. The new regulation provides for liability for the illegal organization of digital currency circulation, accepting cryptocurrency as payment in prohibited cases, and illegal mining. Under certain provisions, fines for legal entities reach 1–2 million rubles.

My View on the Situation

This is not full legalization, but a narrow exception to the previous ban. In essence, the market has been given a "showcase" for legal services, but on a very short leash. Outdoor advertising for crypto services will remain an inconvenient and risky channel — it is extremely difficult to fit all mandatory warnings into a short format. The main advertisers will most likely be banks, brokers, and large financial groups: they already have compliance, lawyers, and experience working with the Bank of Russia. Advertising will become more "bank-like" in tone — calm, without promises of returns and without mentioning coins. For small crypto players, this means that promotion will remain the domain of those willing to invest in compliance rather than in flashy creatives.
