Cryptocurrency advertising in the Russian Federation: New rules open the door for services, but not for coins

Russian legislation has taken an important, albeit cautious, step toward the crypto industry. The new law for the first time permits advertising of services by licensed crypto market participants, but direct promotion of digital currencies as an investment asset remains prohibited. This is a landmark change, but it requires a clear understanding of the boundaries of what is permitted.

What can and cannot be advertised

The key distinction is drawn between advertising the cryptocurrency itself and advertising the services of regulated players. Promoting Bitcoin, Ethereum, or any other coin with the message "buy, it will grow" remains illegal. Advertising cryptocurrency as a means of payment for goods and services within the country also falls under the ban. Any mentions of yield, exchange rate growth, or a "reliable way to earn money" are considered toxic for the Russian legal framework.

Advertising of services by trading organizers, brokers, digital depositories, and exchangers is permitted, but only under strict conditions. The advertisement must necessarily include the name of the organizer, the source of information, a warning about high risks and the possible total loss of funds. It is also necessary to state where the client can familiarize themselves in advance with the risks and legislative restrictions.

Websites, social media, and outdoor advertising

The new requirements apply to all communication channels: from banners and Telegram posts to influencer integrations and outdoor advertising. For online advertising, mandatory labeling is additionally introduced, with data transmitted through an advertising data operator. This is especially critical for the crypto sphere, where the risks of violating several norms simultaneously add up.

An informational article about cryptocurrencies is not advertising in itself. Writing about technology, regulation, or judicial practice is freely permitted. Problems begin where promotion of a specific platform, a referral link, or a call to open an account appears. Outdoor advertising is formally possible, but in practice it will remain an inconvenient and risky channel due to the difficulty of placing all mandatory warnings in a short format.

Penalties and conclusions

Violations of the advertising law carry fines under Article 14.3 of the Russian Administrative Code: for individuals — 2-2.5 thousand rubles, for officials — 4-20 thousand, for legal entities — 100-500 thousand rubles. Separate sanctions for the lack of labeling of online advertising are higher: up to 100 thousand for individuals and up to 500 thousand for companies. If advertising leads to illegal activity, the risks go far beyond advertising fines — up to 1-2 million rubles for the illegal organization of cryptocurrency circulation.

In my assessment, this is not full legalization, but a narrow exception to the previous ban. Large banks and brokers that already have compliance and lawyers will feel the real effect. For the rest of the market, this is a signal: you can move, but very cautiously, in a "banking" tone and without mentioning specific coins. Advertising of crypto services is becoming more civilized, but cryptocurrency itself as an asset remains in a gray zone.
