Russia opens an advertising window for crypto services: what has actually changed

Russian legislation has taken a historic step by for the first time allowing advertising of services by licensed cryptocurrency market participants. However, one should not be deluded: promoting the digital currency itself as an investment asset remains strictly prohibited. This is a targeted relaxation, not comprehensive legalization.

A Fine Line: What Is Allowed and What Is Not

The key innovation is a clear distinction between advertising digital currency and advertising services provided by regulated players. The ban on promoting Bitcoin, Ethereum, or any other coin with calls like "buy, it will rise" remains in force. Also subject to restrictions is the promotion of cryptocurrency as a means of payment for goods and services within the Russian Federation. Any mention of profitability, exchange rate growth, or a "reliable way to earn money" remains toxic under Russian law.

What is allowed is advertising the services of those organizations that will operate under the new rules: trading organizers, brokers, digital depositories, exchangers, and other entities expressly provided for by law. But even here there are strict conditions. Advertising must include the name of the digital currency circulation organizer, the source of disclosed information, and a warning about high risks and the possible total loss of funds. The client must know in advance where to review the risks and legislative restrictions on digital currency transactions.

A separate nuance: naming specific coins in service advertising is not allowed. Calls to open an account and buy Bitcoin look bad. The safe option is to talk about access to digital currency operations through a regulated participant, without mentioning specific coins and without investment promises.

All Channels Under Scrutiny

The new requirements apply to all communication channels: from banners on websites and Telegram posts to influencer integrations, YouTube videos, outdoor advertising, landing pages, push notifications, and email newsletters. For websites and social media, there is additionally a labeling regime for internet advertising: it is necessary to obtain an identifier and transmit data through an advertising data operator. This is especially important for cryptocurrencies—if material simultaneously violates special requirements on digital currencies and internet advertising rules, the risks add up.

At the same time, an informational article about cryptocurrencies does not in itself become advertising. One can write about technology, regulation, judicial practice, risks, mining, blockchain, and international approaches. Problems begin where promotion of a specific platform, a referral link, or a call to action appears.

The Price of a Mistake

For violations of advertising legislation, Article 14.3 of the Russian Code of Administrative Offenses applies. Fines for individuals range from 2,000 to 2,500 rubles, for officials—from 4,000 to 20,000 rubles, and for legal entities—from 100,000 to 500,000 rubles. For internet advertising, sanctions are higher: for the absence of an identifier or violation of requirements for its placement, individuals will be fined 30,000–100,000 rubles, officials—100,000–200,000 rubles, and legal entities—200,000–500,000 rubles.

If advertising leads to activity without the required status, the risk goes beyond an advertising fine. The new regulation provides for liability for the illegal organization of digital currency circulation, for accepting cryptocurrency as payment within the Russian Federation in prohibited cases, for illegal mining, and other violations. Under certain provisions, fines for legal entities reach 1–2 million rubles.

My View on the Situation

This is not full legalization of advertising, but a narrow exception to the previous ban. The real effect will be seen by large financial groups—banks, brokers, and those who already have compliance, lawyers, and a habit of working with the Bank of Russia. Advertising will become more bank-like in tone, and small crypto services will most likely remain in the gray zone. The market has been given a storefront, but only a select few will be able to enter it.
