Russia Opens the Door to Advertising Crypto Services: A New Era of Regulation or an Illusion of Freedom?

Russian legislation is making a landmark, albeit extremely cautious, move toward legalizing the crypto industry. The new law for the first time permits advertising of services by licensed crypto market participants, but direct marketing of the digital assets themselves remains prohibited. This subtle distinction between "service" and "product" will be key for all market players.

What is allowed and what remains prohibited

The key point is the separation of concepts. Advertising bitcoin, Ethereum, or any other coin with promises of price growth or returns is still not allowed. Promoting cryptocurrency as a means of payment within the country also remains prohibited. Any wording hinting at a "reliable way to earn money" or "past profits" is toxic and unacceptable under Russian law.

However, a legal window now opens for marketing the services of those participants who will operate under the new rules: trading organizers, brokers, digital depositories, and exchangers. But even here there are strict conditions. Advertising must include the name of the organizer, disclose the source of information, warn of high risks and the possible total loss of funds. The client must know in advance where they can review the restrictions and risks.

Labeling, bloggers, and outdoor advertising

The new requirements apply to all channels: from banners on websites to Telegram posts, influencer integrations, YouTube videos, and email newsletters. For online advertising, labeling is mandatory, requiring an identifier and data transmission through an advertising data operator. For the crypto sphere, this is especially important: violating both the special requirements and the general rules of online advertising compounds the risks.

At the same time, an informational article about cryptocurrencies does not in itself become advertising. Writing about technology, regulation, case law, or mining is freely permitted. Problems arise where promotion of a specific platform appears, a referral link is included, or there is a call to open an account and buy an asset.

Outdoor advertising is a formally possible but extremely risky channel. In a short format, it is difficult to fit all the mandatory warnings, so it will remain inconvenient for most crypto services.

Fines and reality

Violations of the advertising law carry fines under Article 14.3 of the Russian Administrative Code: for individuals — 2,000–2,500 rubles, for officials — 4,000–20,000 rubles, for legal entities — 100,000–500,000 rubles. Separate penalties for missing online advertising labeling are higher: up to 100,000 rubles for individuals, up to 200,000 rubles for officials, and up to 500,000 rubles for organizations. If advertising leads to activity without the required status, the risks go far beyond advertising fines — up to 1–2 million rubles for illegally organizing digital currency circulation.

In my view, this is not full legalization but a narrow exception to the previous ban. The law is clearly aimed at large players — banks, brokers, and financial groups that already have compliance, lawyers, and a habit of working with the Central Bank. Advertising will become more "banking" in tone, and the main advertisers will be institutional structures rather than startups. For the market, this is a step forward, but a very cautious one: freedom of speech about cryptocurrencies remains strictly limited.
