Russia has opened a "door" for advertising crypto services: what is allowed and where it remains off-limits

The Russian digital asset market is taking a cautious but significant step forward. New legislation for the first time allows advertising of services by licensed crypto market participants. However, as practice shows, this is not a "green light" for the entire industry, but rather a targeted exception to previous strict prohibitions. Promoting cryptocurrency itself as an investment asset or a means of payment remains under a complete veto.

A Fine Line: Services vs. Coins

The key point is that the legislator draws a clear distinction between advertising digital currency as such and advertising services that work with it. Promoting Bitcoin, Ethereum, or any other coin with the message "buy, it will grow" remains taboo. Any mention of cryptocurrency as a way to pay for goods or services in the Russian Federation is also prohibited.

What is allowed is advertising services for those who enter the official registry: trading organizers, brokers, operators of digital depositories, and exchangers. But even here there are strict limits. Advertising must include the name of the organizer, disclose the source of information, warn about high risks and the possible total loss of funds. It is also necessary to state where the client can review the restrictions in advance. A separate prohibition is mentioning specific coins in service advertising. Even a call to open an account and buy Bitcoin would already be a violation.

All Channels Under Control

The new requirements apply to any format: from banners on websites and posts in Telegram to influencer integrations and outdoor advertising. For online advertising, there is an additional labeling regime: it is necessary to obtain an identifier and transmit data through the advertising data operator. If material simultaneously violates both the special cryptocurrency requirements and online advertising rules, the risks are compounded.

It is important to understand: an informational article about cryptocurrencies does not in itself become advertising. Writing about technology, regulation, case law, or mining is freely allowed. Problems begin where promotion of a specific platform, a referral link, or a call to action appears.

The Cost of a Mistake

Violations of the advertising law carry fines under Article 14.3 of the Russian Administrative Code: for individuals — 2,000–2,500 rubles, for officials — 4,000–20,000 rubles, for legal entities — 100,000–500,000 rubles. Separate sanctions are higher for violations in online advertising. But if advertising leads to activities without the required status, the risks go far beyond advertising fines. Liability for illegally organizing digital currency circulation, accepting crypto as payment, and illegal mining can reach 1–2 million rubles for legal entities.

My view: This is not liberalization, but rather institutionalization. The legislator is not opening the market but creating a "showcase" for it within a strict vertical framework. The main advertisers will most likely be banks and large financial groups that have the resources for compliance. For independent crypto services, this means legal advertising will remain complex and risky, and competition will shift toward those already embedded in the traditional financial system.
