Russia opens the door for advertising crypto services, but coins remain banned.

Russian legislation is taking a landmark, albeit extremely cautious, step toward legalizing the crypto industry. Under the new rules, advertising of services by licensed crypto market participants is now permitted, but promoting digital assets themselves as an investment tool remains strictly prohibited. This fundamental distinction between "service" and "asset" creates a new reality for marketing in the industry.

What is allowed and what is prohibited?

The key point of the new regulation is the separation of advertising for cryptocurrency itself from advertising for services provided by legal players. Promoting bitcoin, ETH, or any other coins in the spirit of "buy now, it will grow" remains taboo. Also prohibited is the promotion of cryptocurrency as a means of payment for goods and services within the Russian Federation. Any hints at profitability, price growth, or a "reliable way to earn money" are considered toxic wording incompatible with Russian law.

At the same time, advertising of services by trading organizers, brokers, digital depositories, and exchangers operating under the new law becomes permissible. However, this is only possible under strict conditions: the advertisement must include the name of the organizer, the source of information, a warning about high risks and the possible complete loss of funds, as well as where the client can review the restrictions.

A separate prohibition concerns mentioning specific coins in service advertising. Calls to open an account and buy bitcoin look extremely risky. A safe strategy is to talk about access to digital currency transactions through a regulated participant, avoiding asset names and investment promises.

Distribution channels and risks

The new requirements apply to all channels: from website banners and Telegram posts to influencer integrations, YouTube videos, and outdoor advertising. For online platforms, mandatory labeling of internet advertising is added, with data transmitted through an advertising data operator. This is especially critical for the crypto sphere: if material violates both the special requirements on digital currencies and internet advertising rules, the risks are compounded.

An informational article about cryptocurrencies does not in itself become advertising. Writing about technology, regulation, case law, mining, and blockchain is freely permitted. Problems begin where promotion of a specific platform appears, such as a referral link, a call to open an account, or a promise of earnings.

Fines and prospects

Violation of advertising legislation is punishable under Article 14.3 of the Russian Code of Administrative Offenses: for individuals — up to 2,500 rubles, for officials — up to 20,000, for legal entities — up to 500,000 rubles. Fines for the absence of internet advertising labeling are significantly higher — up to 500,000 rubles for companies. If advertising leads to activity without the necessary status, liability extends far beyond advertising fines, reaching 1–2 million rubles.

In my assessment, this is not full legalization but a targeted exception to the previous ban. Advertising of cryptocurrency as such remains illegal, and only the services of regulated participants can be promoted — in a restrained manner, without promises of profitability or mentioning specific coins. The main advertisers will likely be banks, brokers, and large financial groups that already have compliance and resources to meet the new requirements. For independent crypto services, this is more of a challenge than an opportunity — but the very fact that a legal "showcase" for the industry has emerged already indicates the gradual integration of the crypto market into the Russian financial system.
